Reservation terms
1. Purpose of the online reservation
The website allows visitors to ask for a second-hand item to be set aside free of charge and to choose a proposed collection date and time. The reservation itself is not an online sale and does not create an obligation to purchase. No payment is made online.
2. Availability and confirmation
A reservation is valid only after confirmation by the website. If an item has already been sold, reserved, withdrawn or is affected by an obvious listing error, E:Onze may cancel the reservation and will inform the customer as soon as reasonably possible.
3. Collection appointment
The item is set aside until the end of the selected collection day. The customer is asked to attend at the chosen time and to present the collection code received by email. If the customer cannot attend, they should contact the organisation before the appointment. After the collection day, an uncollected item may be made available again.
4. Cancellation of a reservation
The customer may cancel the reservation before collection without any fee. No refund is required because no payment is taken online.
5. In-store sale and payment
The customer can inspect the item on site before deciding whether to buy it. The sale is concluded in person when the customer accepts the item and pays for it. Payment is accepted by bank card or cash; cheques are not accepted. The price shown on the website is the proposed in-store selling price, subject to correction of any obvious display error.
6. Items offered as free donations
Some items may be marked “Free donation”. Reservation and collection are free of charge and no payment is requested. The beneficiary must still attend the selected collection appointment; otherwise the item may be made available again.
7. No distance-selling withdrawal period
Because the online step is a free, non-binding request to set an item aside and the sale itself is concluded in person on the premises, the 14-day statutory withdrawal period applicable to distance contracts does not apply to this in-store sale.
8. Statutory guarantees for second-hand goods
When the organisation acts as a professional seller to a consumer, second-hand goods benefit from the statutory guarantee of conformity for two years from delivery. For a second-hand item, a lack of conformity appearing within the first twelve months is presumed to have existed at delivery unless proved otherwise. The statutory guarantee against hidden defects also applies under the conditions laid down by law.
The description, condition, visible defects and accessories stated in the listing are intended to inform the buyer before the in-store sale. They do not exclude statutory guarantees for defects that legally fall within those guarantees.
9. Applicable law
These terms and any in-store sale are governed by French law, without prejudice to mandatory consumer-protection rules.
